With the latest from the Deepwater Horizon Settlements showing zero payments made to individuals, zero payments made to business as of September 4 2012, I think the time has now come to Opt out of the Deepwater Horizon Settlements and to sign up with an attorney to let them continue on your fight against BP. The Deepwater Horizon Settlements has been just another waist of time for everybody with still no money coming to the people and business with legitimate claims.
To opt out sign up with an attorney now and they will send you all the information that you need and they will carry your case on to the BP presentment, also called OPA presentment. The documentation that you have provided to the Deepwater Horizon Settlement or to the GCCF can all be used by the attorneys to file your case with BP. Opt Out Of The Deepwater Horizon Settlements
Here is the problem, if you read this and do not fill out a form for the attorneys to opt you our of the BP settlement you are going to end up being stuck in it with all your claims. You will forget about the deadline and do nothing. The end of that story is that you will get no offer or a small offer from the BP settlement and you can do nothing about it. Remember all the people that got stuck with the Quick Pay because they got sucked in to it by the GCCF and now they are kicking them self for falling for that trick. Well this is something similar. For all the seafood harvesters and seafood processors that are stuck with looking at year 2010 as the main year of losses, when the shrimp,oysters and crab did not disappear until 2011 and 2012 here is what you need to know. OPA (oil pollution act ) put a 3 year liability on BP. The Deepwater Horizon Settlement only gives you the 8 month in 2010, where in fact BP is guilty for all the damages happening in the years 2010, 2011,2012 and up to April 20 2013. So the settlement for the industries that did not see the damages until 2011 and 2012 you need to fill out a form and get with an attorney to get the full extend of your losses covered, don’t settle for the damages they are calculating in the Deepwater Horizon Settlements, its not good for you guys.
Oyster harvesters and anybody in the Seafood industry, our good man and attorney general Jim Hood are still fighting to get the Quick Pay overturned as for most people that sign that it was clearly not fair and in most cases the GCCF even used stall and delay tactics to get people to take these Quick Pays. The reversal of Quick Pays would be the single greatest thing that could happen in this battle against BP and I sure hope it will. If it does I hope people will be smarter the next time and get an attorney involved to know their legal rights before signing a contract like this. Incomplete Deepwater Horizon Settlement Claims
If you get back an incomplete or denial letter from the Deepwater Horizon Settlements you should first look to see if the documentation is something you have available to submit to the fund. If its not again you need to fill out the form on the right hand side and sign up with the attorneys they can do sworn statements if you don’t have the documentation. Don’t give up incomplete or denied claims do not mean you cannot get paid by BP. Always have an attorney double check your claim and your paperwork submitted before you give up. The worst thing is people that do nothing because they feel like their taxes are not done or they don’t feel like they can document their losses well enough. Don’t give up just get with the attorneys and let them help you document your losses. This could be done via bank account statements, W2’s or sworn statements. If you do nothing no money will come to you. Remember the attorneys take no payment upfront, they only get paid after you get your money.
I think at this point everybody are pretty tiered of BP, GCCF and now the Deepwater Horizon Settlements, what the H…. are they doing down there. I can understand that Hurricane Isaac hit New Orleans straight on and I am sure there will be some clean up from that but what they Hell is going on. Why are they not processing and putting money in the hands of legitimate people with BP claims ? Why have they only processed 1500 cases and send offers out ? I know we just got the extention for November 1 2012 on the Opt out, but get it done already. Even the lawyers have had enough and they are use to this kind of stuff. One attorney has submitted 1,500 cases and something like 3% have been processed by the Deepwater Horizon Settlement team. If you need more people to process get more people, damn you guys are getting 650 million to do this job now get on it and get it done.

Check Out Your BP Claims Status On Deepwater Horizon Settlements
This is new from last week, want to know what is going on even if you have an attorney handling your case. Well here is what you do. Go to the website Deepwater Horizon Settlements and put in your DWH Claimant ID and last four digits of the claimant’s Taxpayer ID. This will give you the current status of your claim in processing. Even if you have an attorney that are submitting your claim for you they will give you access to status on your case. Now most people that have filed with an attorney would have to get their DWH Claimant ID from the attorney before they can login. For some people having direct access to view their status will maybe feel better but getting the processing moving faster at the Deepwater Horizon Settlements are the main thing now.
Other BP Claims News: The Government Slams BP
The government are slamming BP for its commercials saying everything is ok in the Gulf and most places are better now than before the oil spill. Best commentary about the government case and objections to the BP Settlement is found here
A short summary is the government saying that BP should be found gross negligent over the 2010 oil spill and pay the higher fines both to the government and to the people that got hurt financially from the 2010 oil spill, they say the Deepwater Horizon Settlement is not enough for BP to pay for the damage they caused. The government want BP to pay punitive damages to everybody for the gross negligent that the government feel they can prove with their case against BP. If they do the trial phase of this will become much easier for the individuals and business that are filing suit against BP. It also means BP could pay as much as 20 billion in clean water fines on top of the 20-30 billion in economical damages that for sure is waiting past the Deepwater Horizon Settlements, that could end as soon as November 2012 if the judge does not give final approval for the settlements.
What Did The Preliminary BP Settlement Approval Do For Us ?
Back in May 2012 the judge was asked by BP and the PSC (Plaintiffs steering committee ) to give preliminary approval to the BP settlement (Deepwater Horizon Settlements) and did so because he though it would help get people paid faster or that was the argument of the Attorneys on both sides. Now 5 month later we can see that was a BS story that was told to the judge to get people thinking that money was coming, no money have seen the streets, only 15000 offers have gone out and there are now 60,000 claims in the deeepwater Horizon Settlement and climbing. Why is it taken so long, the clients with attorneys have been submitted for month now and still no processing and no offers. How many people do they have to do this ? Are they all doing their job ?
As I wrote in an earlier post I had heard some inside chatter about a big wave of offers coming in the first week or September, well we are here. I will give them an extra week because of hurricane Isaac but after next week I will tell everybody that I am personally talking to, that the end of our patient has come and for they to lawyer up and get ready for trial. I am sure that a jury of our peers would give us compensation for the time it took to get the money out of BP and for all the other relate damages this oil spill has caused us and our families. 1 more week that is all my patient has left.
