  • In the start of the year most of my call was from individuals with smaller claims that was not getting their BP claims paid by the GCCF. This has now change as most of the smaller claims up to 50,000 has been paid by the GCCF.     Our Process of Getting Your BP Claims paid by the GCCF

    Its all about having a plan with people you trust on getting your BP Claims paid by the GCCF, at this point I think most people would agree that the plan the GCCF has put in place of getting your claim paid has not worked for you. So let me layout the plan that is already a proven concept and it has been in place since 2010.

    First you fill out the free case review and we will send you a confirmation email confirming receipt of your BP claims information. After an attorney looks over your claim and gives you a call, all legit claims denied by the GCCF or not paid by the GCCF will be accepted by the attorney’s.

    The GCCF has 90 days to come back with an offer on your claim, right now we see anything from 2 -6 weeks before we hear back from them.

    This would be an interim offer and a final offer. If the offer follows the accountants workup and multiplier on your claim then the attorney will recommend you that you take the offer.

    If the offer is lower than the claim submitted the attorney and claims department will talk directly with the GCCF telling them where they are wrong on their numbers. This normally results in a second offer from the GCCF that are much closer to the number the claims department was asking for.

    If the GCCF offer is not close a lawsuit will be file on your case and BP will be put on alert that we are going to trial. As an attorney its great to know that your opponent do not want to go to trial, this means that they can push hard for trial and a settlement offer will eventually come their way.

    This is again the reason why we use attorney’s and not consultants because they have the power of filing suit if the GCCF is not playing fair, from what we have seen that is probably a good thing.

    Again this pushes them to make another settlement offer before trial. Only 2% historically goes to trial, I would suspect in the oil spill this number would be less than 0.5% as BP do not want to go to trial and get hammered by bad publicity and get a possible verdict that will cause other claims to be valuated higher.

     

    This plan will work best for you if you got everything into the GCCF this year, as February 2012 is when trials start and you want to be fully worked up and ready when this rolls around. Another reason for getting in with a great attorney this year would be the fact that the GCCF will run out of money with 20 billion dollars. It might sounds strange when 1/2 the claims only amounts to 6 billion dollars but it goes to what I said before with paying the smallest claims first.

    Deck hands and charter boat capt. We see that Deckhands are getting up to $60,000 for their claims even with not great records, we are seeing Charter boat captains  getting 4-5 times future loss paid.

    Oyster Men are getting paid up to 6 times 2010 losses, if you have oyster leases or have an oyster boat fill out a form and let us show you what is possible.

    Another group that we are seeing getting paid well are servers we are seeing $36,000 being paid on smaller losses, so future pay is being given to servers.     BP Claim: GCCF Vs. Settlement

    Even before BP dumped all of their oil into the gulf, gulf coast residents had a lot to deal with, just like everyone else. People are busy making ends meet, taking care of their families, and keeping their businesses running or working hard at their jobs. Now that the oil spill wrecked a lot of people’s livelihoods, those same problems didn’t go away, but now there is a whole set of new ones to figure out your BP Claim. Who has time to do a ton of research on the best way to get the money they deserve through a BP claim? I’m going to do my best to break down the difference between getting a BP claim through the GCCF or doing it through an attorney.

    The main things everyone needs to know about their BP claim are 1) How much money will I get? and 2) How quickly will I get it?

    How Much Money Will I get for My BP Claim?

    For starters, let’s go over the amount of money you would get from each. The GCCF has been delaying people to make them desperate so they will accept their quick pays of $5,000 personal and $25,000 business, so those amounts are what most people will get if they stick with the GCCF for their BP Claim. If you’re looking to get more out of a final claim, the GCCF will probably just keep delaying or denying you. You might get lucky and get offered a little more, but it still probably won’t be as much as you lost.

    If you decide to get some representation and take BP to court, the amount could vary a lot from person to person, but it’s pretty safe to say it’s going to be closer to what you deserve than those crap quick pays the GCCF is so eager to get you to accept. The reason you will probably get more out of your BP Claim this way is that a lawsuit will give you compensation for up to 3-5 years of losses (which is likely what you will actually lose) instead of the set quick pay amount the GCCF will try to force on you. Even if you get offered a final settlement for your BP Claim through the GCCF, it will still probably only compensate you for 1-2 years of losses.

    How Fast Will I Get my BP Claim Money?

    It seems like it would take longer to go through the courts to get paid than through the GCCF, but there is a little more at work here than you might think. Firstly, if you take the quick pay, you will probably get it after the 90 days the GCCF promises. If you want an interim or final payment, good luck.

    The GCCF loves to delay BP claims by taking longer than the 90 days they say they will. Then once they finally get around to processing your claim, they usually delay by asking for more documentation on your BP Claim (documentation that they don’t need). Once they finally have to finish delaying, they will often just deny you even if you have a good claim, or they will say they overpaid you for your emergency BP Claim payment (which is a lie). After all this, it could be a long, long time before you see any money from the GCCF, if you ever get any at all.

    If you decide to go with an attorney, you could get a settlement for your BP Claim in as quickly as 60 days. That’s not always the case, but it’s pretty common. Most of the time, you can get a settlement before the GCCF would have finished processing your claim. There are a few things you should know if you decide to do this to get your BP claim though. First of all, if you take a settlement now, you will get the money faster, but you might not get as much as if you wait.

    Why Is It Like This?

    The reason you might be able to get more if you wait on your BP Claim is because there is a big lawsuit to figure out which companies are liable for the oil spill, but it’s not going to happen until February 2012. If you are able to wait until then to get your settlement, you will probably be able to get compensated a lot more for your BP Claim. If you can’t wait that long because you have a mortgage or other reason you just have to have the money now, you can still get a settlement for your BP Claim quickly, it just won’t be quite as much. It will still probably be a lot more than a GCCF quick pay though.

    The Bottom line is, going for a settlement to get your BP Claim will probably get you more money, and will get it to you faster.     Not Getting Paid By The GCCF ?

    There have been more and more reports coming in lately about the GCCF using stall tactics to avoid paying out legitimate claims to needy gulf coast residents. Despite having sent in everything that could possibly be needed to process a claim, the GCCF continues to request more information, claims to have lost information sent, or even moves its own GCCF offices without notice.

    Reasons Why GCCF Stalls The Money

    There are two reasons for the GCCF to do this, and I think both of the reasons make it very clear that the delays are intentional. The longer the GCCF makes claimants wait, the more desperate they get as mortgage payments and other necessities come due. This makes people more likely to accept low GCCF offers when they are offered later, even if the offer from the GCCF is nowhere near as high as it should be. The second reason the GCCF is intentionally delaying payments is that they simply do not have enough money to pay all the claims. BP decided that they would pay  $1.25 billion every quarter, which is not nearly enough for the hundreds of thousands of claims they owe. Apparently no one thought it would be a good idea to tell BP that they should be paying enough to actually cover the damage they caused. Because of this, the GCCF is doing everything it can to avoid paying claims, hoping that it will eventually get enough people to accept the low quick pay payments that they can afford.

    Alternative to GCCF

    This is all bad news for people trying to get money from the GCCF, but there is something you can do about it. Just like when an insurance company makes a low offer for a claim, but decides that suddenly you deserve more when you tell them you have an attorney, they are more likely to give you what you deserve if you get some legal help.
